Whether an EB-5 investment qualifies for the reduced threshold depends on whether the project location meets the applicable TEA requirements, not simply on how the project is marketed.
You generally file Form I-829 during the 90-day period before the second anniversary of becoming a conditional permanent resident through EB-5. The petition must show that the required investment was made and sustained and that the job creation requirements have been met or will be met within the permitted timeframe.
